MONDAY MARCH 23 2020 – A MARINE BAN FOR RECREATIONAL BOATING IS IN PLACE – WE ARE OPEN FOR BUSINESS TO DISCUSS YOUR CURRENT OR FUTURE TRIP. GROUPS MAY ELECT TO RESCHEDULE ANY TRIP ORIGINALLY SCHEDULED DURING THE DATES OF MARCH 23 TO APRIL 12 2020 FOR UP TO ONE YEAR. ONCE THE LOCAL BAN IS LIFTED, WE WILL RESUME OPERATIONS. (THIS DATE IS LIKELY TO PUSH OUT FARTHER INTO THE FUTURE – STAY TUNED FOR CONTINUING UPDATES).

ARTICLE. 3-23-2020 BOAT BAN PALM BEACH COUNTY
IN THE EVENT OF A NATIONAL OR STATEWIDE MANDATORY QUARANTINE INVOLVING FLORIDA AND/OR 75% OF YOUR GROUPS PRIMARY STATE OF RESIDENCE THAT PROHIBITS ANY TRAVEL AND WHICH ALSO CLOSES THE MIAMI (MIA) / FORT LAUDERDALE (FLL) AIRPORTS OR PROHIBITS MARINE TRAFFIC IN MIAMI-DADE AND BROWARD COUNTY, FL AND LOCKS DOWN THE REGION FOR YOUR TRAVEL DATES, A FORCE MAJEURE CONDITION MAY BE PUT INTO EFFECT. ALTERNATIVELY, AN AUTOMATIC POSTPONEMENT WITHOUT PENALTY WILL BE ISSUED FOR UP TO ONE YEAR FROM THE ORIGINAL DATE OF TRAVEL TO A MUTUALLY CONVENIENT DATE.
FORCE MAJEURE
The performance of the Contract by either of the parties is subject to acts of God, acts of any governmental authority, adverse weather conditions, war conditions, including by not limited to acts of terrorism, civil unrest or disobedience or other conditions unforeseeable by or beyond the control of either party making it impossible or illegal to provide the facilities (the vessel) and to hold the event. However, the parties will use all best efforts to adjust to the current circumstances so as to fulfill the intent of the Agreement.
If a Force Majeure situation arises, the party claiming the Force Majeure shall promptly notify the other in writing of such conditions and the cause thereof. The occurrence of Force Majeure shall be confirmed by the appropriate and relevant Government agency.
In the event Force Majeure conditions are invoked, the Charterer shall be entitled to a full refund of the charter fee and deposits, less event planning/commitment costs incurred or committed by Owner and/or agents in connection with the charter up to and including the notification date of the Force Majeure. Event planning/commitment costs may include but are not limited to third party commitment costs such as food supplies, services, dockage fees, entertainment and reasonable administrative costs, NOT TO EXCEED 25% OF THE TOTAL ORIGINAL INVOICE. In any event, the Owner shall return any remaining balances to the Charterer. However, if the event planning/commitment costs incurred by the Owner exceed the deposits paid, the Charterer shall be responsible to the Owner for these expenses.
